Employer Work Permit

The application process for the New Zealand Employer Work Visa (Accredited Employer Work Visa) can be divided into three main steps:

  1. Employer certification: First, the employer needs to go through the certification process of Immigration New Zealand. Only certified employers can recruit overseas workers. The purpose of certification is to ensure that employers have good recruitment and employment compliance and the ability to support overseas employees working and living in New Zealand.
  2. Advertise for job review: After an employer is accredited, it must advertise for the required position and conduct a market test to confirm whether a New Zealand resident or citizen can fill the position. This step ensures that employers can only hire overseas staff if there are no suitable local candidates
  3. Employee applies for a visa: Once the position is approved, the employee can start applying for an employer work permit. During the application process, employees are required to provide necessary personal information, proof of qualifications, and work experience relevant to the position for which they are applying. Immigration will review the application to ensure that the employee meets the visa requirements and that working in New Zealand will not adversely affect the local labor market.

    Applicants need to meet the minimum skill requirements: Level 4 or above or 3 years of relevant industry work experience. If the position is ANZSCO4-5, the applicant also needs to reach IELTS 4 level.

Immigration Bureau requirements for employers:

Along with the approval of employer certification, the Immigration Bureau requires employers to fulfill the following obligations:

  1. Ensure that the people in your company making hiring decisions complete the online Employer Module while the certification is valid. You can access the Employer Module via the following URL link: https://employment.elearning.ac.nz/
  2. The company ensures that work visa holders for recognized employers complete the online employee module with pay within one month of starting their employment. The online module can be accessed via:  https://employment.elearning.ac.nz/
  3. Companies are required to provide the following information to employees to support Approved Employer Work Visa holders settling in New Zealand within one month of starting work. Information includes:
    1. Accommodation options
    2. Transportation options, including driving and driver's license information, and public transportation options
    3. Living cost estimate
    4. How to get health care
    5. Citizens Advice Bureau
    6. Relevant community groups
    7. How to obtain a tax bureau number
    8. Availability options for industry training and qualifications
    9. Specific job and industry hazards
  4. The company needs to provide relevant resettlement information to your customers: Please refer to the attached (Settlement support for Migrant info) for your reference. You can give this document to the work permit holder. The Immigration Bureau will need evidence that you have provided this document to the worker.
  5. Companies need to keep records of when they recruit employees to demonstrate how they take reasonable steps to ensure that applicants meet the minimum application requirements of the Immigration Service.
  6. If any employee with an employer's work permit resigns, the employer must send the employee's resignation information and form within 10 days(Confirmation from Accredited Employers that an AEWV holder has left their employment)to the Immigration Bureau (AEWVEmployerDeclarations@mbie.govt.nz), unless the employee’s visa is valid for less than one month.
  7. The company needs to ensure that before sending a work permit invitation, it checks whether the applicant meets the minimum work permit requirements (3 years of work experience or NZQF Level 4 or above, English requirements, etc.).
