Spouse work permit/immigration

There are several key points involved in applying for a partner work visa or immigrant category visa:

  1. Genuine and stable relationship: Applicants and their spouses must demonstrate that their relationship is genuine and stable. This means that their relationship should be of lasting quality and that both parties have clear intentions for their future life together.
  2. Cohabitation requirement: The applicant and his/her spouse need to prove that they have been living together for a reasonable period of time. Although there is no specific time requirement, it is generally expected to have a record of cohabitation for at least 12 months. If you are applying for spouse immigration, you must have lived together stably for at least 12 months to meet the application requirements.
  3. Proof of relationship: Applicants need to provide sufficient evidence to support that their relationship is genuine. This may include joint financial accounts, proof of joint tenancy or property ownership, evidence of shared parenting, family photos, records of social interactions, etc.
  4. Legally or de facto marriage: The applicant and his or her spouse must be partners in a legal or de facto marriage. If it is a de facto marriage, both parties need to provide evidence to prove that they have lived together for a long time and regard each other as marital partners.
  5. Eligibility to support spouse immigration: As a spouse immigration sponsor, the spouse must be a New Zealand citizen or resident, and has not sponsored or been sponsored by other people to immigrate in the past 5 years. The sponsor must not have a history of domestic violence or sex-related crimes.
  6. Eligibility to support a spouse's work permit: As a sponsor for a spouse's work permit, the spouse can be a New Zealand citizen or resident and has not sponsored or been sponsored by anyone else to immigrate in the past 4 years. If the sponsor has a temporary visa, he or she must meet at least ANZSCO level 1-3 work permit, or a green list work permit/study permit, or a level 9 or above study permit. The sponsor must not have a history of domestic violence or sex-related crimes.
  7. Applicants must meet other immigration requirements: these include health requirements, character requirements, etc. Applicants may be required to provide proof of criminal record and medical examination results.
